Botner testified that Flynn repeatedly said he hated his wife, referred to her with derogatory names, and told her he would kill Ashley if he could find a way to avoid jail. In one exchange, Botner wrote, “I want to kill her, Caleb.” Flynn responded, “That makes two of us.”
The night before Ashley was killed, Flynn texted Botner: “I choose you. I’m free. Actions will come tomorrow, February 16, a day I’ll never forget.”
What the Daughters Asked
Ashley’s sister, Kayla Keyt, testified about the couple’s daughters’ reaction when they learned of their father’s affair. The girls were “heartbroken, shocked and upset for their mom.”
They had one question: “She loved daddy more than anyone else in life. So why did Daddy not love her as much?”
The Defense
Flynn has pleaded not guilty to aggravated murder, murder, felonious assault, tampering with evidence, and intimidation of a witness. His defense attorney, Emily Smith, acknowledged the affair but argued it proved motive, not murder.
“A man can fail as a husband without being a murderer, and a man can make selfish decisions without committing a crime,” Smith told the jury. She argued that the state lacked the murder weapon and had rushed to judgment based on Flynn’s infidelity.
